  1. THE DE’LONGHI MONEY BACK GUARANTEE PROMOTION 2023 (THE “PROMOTION”)

    THE REPUBLIC OF IRELAND TERMS AND CONDITIONS

    1. Promoter: The Promotion is conducted by Kenwood Limited, 1 Kenwood Business Park, New Lane, Havant, Hampshire, PO9 2NH, United Kingdom (“we“, “us“, “our“).

    2. Promotion Period: The Promotion is valid while stocks last from 00:00 on 1 December 2023 to 23.59 on 30 May 2024 (inclusive) (the “Promotion Period”).

    3. Purchasing Qualifying Products: The Promotion is available for all purchases of the Qualifying Products (defined in point 5 below) made by you during the Promotion Period in-store and online via the Irish websites of participating De’Longhi retailers below (“Retailer(s)“).

    4. Eligibility: All customers of the Retailers and the UK De’Longhi Website who are resident in the Republic of Ireland and aged eighteen (18) years of age and over (“you“, “your(s)“) are eligible to participate in the Promotion and, by participating in the Promotion, you agree to be bound by these Terms and Conditions (which may be amended or varied at any time by us).

    5. Qualifying Products: The following De’Longhi Fully Automatic and Manual Bean to Cup Machines purchased during the Promotion Period are the qualifying product for the Promotion:

    (“Qualifying Product(s)“).

    The model number is located on the packaging of the Qualifying Product or on the underside of the Qualifying Product. If you are unsure whether a product is a Qualifying Product in-store, please ask a sales assistant.

    6. Obtain a copy of the Terms and Conditions: You can obtain a copy of these Terms and Conditions at www.delonghirewards.ie/terms/ or by writing to De’Longhi Gifts, 12 Northbrook Road, Ranelagh, Dublin 6 to receive a hardcopy in the post. All changes will be posted in revised Terms and Conditions on the www.delonghirewards.ie/terms/ Website and will be available in hardcopy by post by calling +353 (01) 6619966.

    7. To claim; please access our dedicated website at www.delonghirewards.ie and follow the online instructions.

    (a) You will be asked; your name and full address (incl. postcode),  Qualifying Product purchased, date of purchase, purchase price and reason for return. You will need to provide a copy of your purchase receipt (scan or photograph is acceptable) which must detail the retailer, the Qualifying Product and purchase price in EUROS (€). If these details are not shown on the receipt or the applicant does not have a receipt, the application will not be processed, and an email will be sent advising this.

    (b)Claims must be made between 30 and 100 days of purchase date on the purchase receipt and no later than 100 days following the offer closing date of 23:59 p.m BST on 30 May 2024. Applications received later than 100 days following the 30 May 2024 will be rejected. Applications will be rejected if made within 30 days of purchase.

    (c) If your application is accepted you will receive an email confirming this (within 10 working days) and telling you what you need to do to return your Qualifying Product, omitting the Welcome pack, to the address provided. You must do this within 28 days of receiving the acceptance email.

    (d) We suggest you obtain proof of postage and ensure your courier has the correct level of insurance to cover your returned Product. Note: We will not accept any liability for additional costs associated with return postage costs which are not included in the Money Back Guarantee.

      (e) All care should be taken to ensure the returned product is adequately packaged and protected in transit to avoid loss or damage. Your Qualifying Product will be quality checked upon return and we reserve the right to deduct from the refund the cost of any missing items, rectifying damage to the product or if the product does not turn on. If this applies you will receive an email within 28 days of the Qualifying Product being quality checked, detailing your reduced money back amount. You will be able to track the progress of your claim and if any refund reduction applies you will receive an email confirming this.

    (f)If your application is rejected you will receive an email detailing the reason for rejection. If any proof of purchase is resupplied, you must do so by midnight 14 days after of the date of the rejection email. If you do not do so, you will have to start the claims process again. The original timeframes shall apply.

    (g)No responsibility is accepted for applications that are ineligible, incomplete, misdirected, or late submissions. Proof of posting will not be accepted as proof of delivery. Responsibility cannot be accepted for lost, damaged or delayed returns and /or their contents. The Promoter accepts no responsibility for applications not successfully completed due to a technical fault, computer hardware or software failure, satellite, network, or server failure of any kind. The Promoter shall not be liable for any delay or failure due to any event beyond our control.

      (h) The Promoter will refund the actual purchase price paid for a maximum of one Qualifying Product purchased, as evidenced on the Participating Retailer purchase receipt. A bank transfer to that value will be made out to the name, address and account details supplied on the application; please allow 28 working days after the date of your returned Qualifying Product being accepted for the bank transfer to be made and allow 5 days or the bank transfer to clear.

    1. The refund amount will not include postage costs for the return of the Qualifying Product.

    8. This offer cannot be used in conjunction with any other Promotion run by the Promoter in respect of the product. You may not transfer or assign any or all of your rights and obligations under these terms and conditions.

    9. This Promotion does not affect your statutory rights.

    10.  By participating in this Promotion, participants are deemed to have accepted these terms and conditions, which can be found at www.delonghirewards.ie/terms/ . The Promoter reserves the right to refuse a refund to anyone in breach of these terms and conditions.

    11. The Promoter reserves the right to amend or withdraw this promotion at any time without prior notice. You can still claim under these terms for any eligible purchase made before the termination date.

    12.  The Promoters decision is final and binding in all matters.

    13. Participants information will be used for the sole purpose of administration of this Promotion except where a participant has opted in to receive future communications from the Promoter.     15. Privacy:

    (a) As part of this Promotion, we will be entitled to use your personal information for the purposes of administering the Promotion and allowing your participation in the Promotion. Your personal information will be collected, stored and used in accordance with our privacy policy, which is available at www.delonghirewards.ie/terms/ .   

    (b) We and our selected third party partners may use any personal details you provide to us to contact you from time to time (including by e-mail) about promotions, products and services we think might interest you.  However, we will only do this where your marketing preferences indicate you wish to be contacted for this reason.

    16. Governing Law: The Promotion and these Terms and Conditions shall be governed by English law and shall be subject to the non-exclusive jurisdiction of the English Courts.

    17. The Data Controller (as defined in the General Data Protection Regulation ((EU) 2016/679)) is Kenwood Limited, 1 Kenwood Business Park, New Lane, Havant, Hampshire, PO9 2NH. The Data Processor (as defined in the General Data Protection Regulation ((EU) 2016/679)) is InSight Marketing & Brand Services Ltd, 47 Terenure Road East, Dublin 6, D06 AH75.

    18. The Promoter reserves the right to change the terms and conditions, and void, cancel, suspend or amend the Promotion where it becomes necessary to do so in the event of circumstances beyond its reasonable control.

    19. The Promoter’s decision regarding any aspect of the Promotion is final and binding.
